These terms govern your use of emrge.shop and any purchase you make from us. By using the site or placing an order, you accept them.

1. Who we are

EMRGE ("we", "us", "our") sells made-to-order apparel online and operates from New York, United States. General enquiries: hello@emrge.shop.

2. Eligibility

You must be at least 16 years old to place an order, or have the consent of a parent or guardian. By ordering you confirm the payment method used is lawfully yours.

3. Products

We photograph every product as accurately as we can, but screens vary and small batch variation is normal in garment manufacturing — fabric, dye and wash can differ slightly between production runs. Measurements published in our size guides are taken flat and may vary by up to 1 inch / 2.5cm.

4. Orders and pricing

All orders are subject to acceptance. We may refuse or cancel an order where an item is unavailable, a price or description is wrong, or we suspect fraud. If we cancel an order you've paid for, we refund you in full.

Prices are shown in the currency of your region. EU prices include VAT. Prices outside the EU exclude any local taxes or duties, which are your responsibility.

5. Made to order

Production begins after your order is placed. Because of this, orders cannot generally be changed or cancelled once production has started. If you need to change something, email support@emrge.shop immediately and we will help where we can. This does not affect the statutory cancellation rights of EU and UK customers set out in our Returns & Refunds policy.

7. Affiliates and athletes

Participation in the EMRGE affiliate or athlete programme is subject to separate terms provided on enrolment. Commission is earned only on qualifying sales to third-party customers. We do not pay for recruiting other affiliates, and we make no representation about earnings.

8. Intellectual property

The EMRGE name, logo, "Break the Cycle" wordmark, designs, photography and site content are our property and may not be reproduced, printed or used commercially without written permission.

9. Acceptable use

Don't use the site unlawfully, attempt to breach its security, scrape it, or resell our products as your own brand.

10. Liability

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded. Subject to that, our total liability in connection with any order is limited to the amount you paid for it. We are not liable for indirect or consequential loss.

Your statutory rights as a consumer are not affected by these terms.

11. Governing law

These terms are governed by the laws of the State of New York, United States, and the courts of New York shall have jurisdiction. If you are a consumer resident in the European Union or the United Kingdom, you retain the protection of the mandatory consumer law of your country of residence and may bring proceedings in your local courts.
